Crossing Into Alabama on a Weekend Trip? Fault Rules Shift
For Emerald Coast drivers, a quick trip to Orange Beach, Gulf Shores, or Mobile barely feels like leaving home. Highway 98 and I-10 make the drive easy. What changes at the state line isn’t the scenery. It’s the set of rules that decides who pays after a crash.
Mile Marker One: What Florida Does Differently
Florida uses a no-fault approach for injuries. Your own Personal Injury Protection handles a portion of your medical costs and lost income regardless of who caused the accident. When fault does come into play, Florida now uses modified comparative negligence, meaning a driver who is more than half responsible generally can’t recover from the other side, while a driver less at fault sees their recovery reduced by their share.
Mile Marker Two: What Alabama Does Differently
Alabama is a traditional at-fault state with no PIP requirement. It also follows contributory negligence, one of the strictest standards in the country. If you’re found even slightly at fault in an Alabama crash, recovery from the other driver can generally be barred.
Mile Marker Three: What Travels With You
- Your Florida policy generally follows you across state lines
- Florida PIP can often still apply to you while you’re riding in your insured vehicle out of state
- Collision coverage repairs your vehicle regardless of fault in either state
- Uninsured motorist coverage, if you carry it, can matter even more on the Alabama side
Mile Marker Four: Before You Head West
- Keep a current digital or printed ID card in the vehicle
- Confirm whether your policy includes collision and uninsured motorist coverage
- Photograph the scene and collect witness details after any incident, since fault can carry more weight in Alabama
